The Actual Terms & Conditions are showing and explain the conditions and rules that every customer could meet during the payment/order process. From the product to the delivery, all terms and conditions must be respected. Terms & Conditions at Pride Racing Parts are also presenting all the rights and obligations regarding the selling process of all products from the « Pride Racing Parts » Company or anything coming from « Pride Racing Parts » website, all without any exceptions. Accordingly, the fact of any person who order a product that the Company « Pride Racing Parts » is selling from the website is meaning that the customer accept all the Terms and Conditions and knew all the conditions before ordering. The products are for sale on the following geographic territory : Metropolitan France, Corsica, DOM TOM and every state in the world. The buyer avowed before his order that everything bought from the website and from « Pride Racing Parts » is not related to a professional activity or business, only for a personal using. Also having the entire legal capacity that allowed the buyer to engage and accept all the actual terms and conditions. « Pride Racing Parts » is allowed to change the actual terms and conditions whenever the company wants.

The buyer can access to the website with his own material or devices to navigate on the website and be able to order. The buyer is taking care about the communication/connexion charges during the navigation on the « Pride Racing Parts » website.

4. Contract formation and Orders

4.1. Price

The selling price on the « Pride Racing Parts » website is with the EURO (€) currency, all order made on the website will be calculated with the EURO currency and shows up on the order receive. The price and availability of any products on the website are totally reliable. A product bought doesn’t mention any shipping cost, the shipping cost is added to the general basket at the end of the order registration. Every price has Taxes to the Added Value (T.V.A) on each product or shipping costs. TVA Taxes could be changed at any times and will be adjusted to the price of every products sold on « Inpsyre Bicycles » website. This modification will be notified to the customer before processing the order.

4.2. Products details - Availability

Respecting the article L 111-1 of the Consumer Code, the buyer could before ordering, take care and read the full detail of each product that he needs to order. The buyer could choose many products from different categories on the « Pride Racing Parts » website : Frame, Braking system, Wheels, etc. All the offers mentioned by « Pride Racing Parts » are available for the products in stock only. « Pride Racing Parts » reserve their rights to change the stock, the content, pictures, informations on each product on the website. Pictures, Graphic contents, descriptions and informations of each product are specially here to inform the client.

4.3. Orders

All orders seems that the customer is aware of every rules and terms and conditions. As soon as the buyer registered his order, by pushing the « Validation order », it says that the customer agreed all the terms and condition of « Pride Racing Parts » company. The customer could order on the web at « Pride Racing Parts » the order has to be confirmed by « Pride Racing Parts » by Email. The sale will be done after sending the order confirmation by Email and paid the total amount of the order. « Pride Racing Parts » advice the customer to always keep a paper or email from the confirmation or any exchange with the customer services.

5. Payment of the price

The payment of the total amount needs to be done when the basket of the order is finished by the buyer. At no time, any payments or amounts transferred would be accepted as a deposit. The payement of the total amount will be done by « Pride Racing Parts » during the process of the order and make it an order confirmed.

Every orders can be paid with EURO (€) currency. To achieve your order, the buyer has a multiple choice for paying the order (credit card ; PayPal ; VISA ; MASTERCARD or Bank Transfer).

The buyer confirmed to « Pride Racing Parts » that he has all the rights needed to use the payement that he chose, when registering the order. « Pride Racing Parts » has the rights to cancel or hold the order (with deliver), whatever the situation in case of not paying the order or error of payement.

Penalties of an amount equal to the legal interest rate increased by five points are automatically applicable to the unpaid amounts at the end of a period of ten days following the date of invoicing or upon notification of the rejection of bank payment for any other means of payment.

Delivery of all new orders can be held up in case of a late payment, also ignoring the previous payment conditions. 

« Pride Racing Parts » is allowing their rights to ask a copy of the ID card from the buyer for any Card payment. Fighting against Internet fraud, every informations related to the order could be transferred for a verification.

6. Choix des produits

The buyer should know all the informations and details about the products sold by « Pride Racing Parts ».has under his sole responsibility and according to his needs as he has previously determined before any order, made his choice on the product or products subject to his order. In addition, the Buyer, knowing only the materials, configurations and others, that he uses, is the sole judge of the compatibility of the products ordered with those used by him. It is exclusively up to the Buyer, if he does not consider himself sufficiently competent, to be assisted by a consultant.

7. Delivery and shipping

7.1 General conditions 

The products will be delivered to the address indicated by the Purchaser on the order form. The Buyer may, at his/her express request, have the invoice sent to the billing address and not to the delivery address by validating the option provided for this purpose on the order form. In the event of partial availability of items, "Pride Racing Parts" may split orders. This means that the available items may be sent first, and the balance of the order will be sent when all the other items are available.

8. Products avaibility

In case of any products sold out, « Pride Racing Parts » inform the buyer as soon as possible. In accordance with the dispositions of the article L121.20.3 of the Code of the Consumption, « Pride Racing Parts » would be able to advice a similar price or product. In any case, the ordered products will be delivered within a maximum of thirty days from the day following the one when the Buyer registered his order, subject to the complete payment of the price.

A défaut pour "Pride Racing Parts" de faire usage de cette faculté, l'Acheteur sera remboursé sans délais et au plus tard dans les trente jours du paiement des sommes qu'il a versées.

If « Pride racing » couldn’t respect the delivery delay mentioned above, the buyer will be refunded.

9. Rights of cancellation

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have the right to withdraw from this contract within 14 days without giving any reason and without incurring any penalties.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you (other than the carrier), take physical possession of the goods (or of the last item in the case of an order consisting of multiple goods delivered separately).

To exercise your right of withdrawal, you may use the withdrawal button available in your customer account and within the details of your order, or notify us of your decision by means of an unequivocal statement (for example, by using the form available HERE).

An acknowledgment of receipt of your withdrawal request will be sent to you without undue delay on a durable medium.

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of standard delivery, no later than 14 days from the date on which we are informed of your decision to withdraw. Reimbursement will be made using the same means of payment as used for the original transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having sent back the goods, whichever occurs first.

10. Reservation of property

« Pride Racing Parts » keeps the entire property of all products sold until the total price placement, within Taxes and Fees. During the period of shipping, delivery, to the transfer of property to the buyer, stilling, destructions are in charge of the customer.

Failure by Buyer to meet its payment obligations shall entitle Seller to demand immediate return of the goods delivered at Buyer's expense and risk.

11. Warranty

Terms and Conditions and duration of the warranty are available on the « Pride Racing Parts » website in the SAV part.

« Pride Racing Parts » is considering that the buyer is aware and accepted all the term and conditions about warranty

In case of the product leaflet couldn’t be delivered to the customer, on a simple request « Pride Racing Parts » will be able to share the right leaflet related to the product in French or English.

Any return of the product under the warranty must be subject to prior approval by "Pride Racing Parts".

At the end, the buyer will contact the claim service of « Pride Racing Parts ». No returns will be accepted without autorisation from « Pride Racing Parts »

If the product is claimed as a defective product, « Pride Racing Parts » will send a return label to the customer.

This return number, which is a determining and indispensable condition, is valid for seven working days from the date on which "Pride Racing Parts" communicates the return number to the Purchaser.

After this period, the Purchaser must redo his request, according to the procedure described above. The defective product must be returned in its original packaging, with all of the product and its accessories, and be legibly accompanied by the product return number communicated by « Pride Racing Parts » and the product serial number.

Any product that is incomplete, damaged, and/or the original packaging has been damaged, will not be returned or exchanged under the guarantee.

All costs and risks related to the return of the product are the responsibility of the Buyer.

The product under warranty will, at the manufacturer's option, be exchanged or repaired. "Pride Racing Parts" only guarantees the Purchaser, with respect to hidden defects that may affect the products delivered, within the framework of a replacement of the defective products, or of the parts that make them unfit for use, without being able to be considered by the Purchaser as being responsible for the possible harmful consequences that these hidden defects may have caused.

En tout état de cause, les garanties ne couvrent pas :

•     the replacement of consumable materials

•     abnormal and non-compliant use of the products

•     damages specifically mentioned in the article sheets 

•     defects and their consequences due to the intervention of the Buyer or a repairer not approved by « Pride Racing Parts »  

•     Defects and their consequences related to the use not in conformity with the use for which the product is intended (professional use, collective ...)  

12. Responsibilities

The products offered by « Pride Racing Parts » comply with current French legislation. « Pride Racing Parts » shall not be held liable for failure to perform the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, particularly of the postal services and means of transport and/or communications. « Pride Racing Parts » shall not be held liable for any indirect damage that may arise from the purchase of products. « Pride Racing Parts » shall not be held liable for any damages or reimbursement in the event of total or partial inability to use the products, in particular due to equipment incompatibility. The « Pride Racing Parts » website also contains information from third parties and links to other websites. In no event shall « Pride Racing Parts » be liable for any damages arising out of the use of, access to, or inability to use such third party information or the content of such other web sites.

13. Partial invalidity

If one or several stipulations of the present general conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their range.

14. Non waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general conditions of sale shall not be interpreted for the future as a waiver of the obligation in question.

15. Applicable law

Sales of products by the company « Pride Racing Parts » are subject to French law.  

16. Information Technology and Civil Liberties

The information collected by « Pride Racing Parts » when the Purchaser places an order is necessary for the management of the order by "www.inspyre-bicycles.com" and its commercial partners. In accordance with the French Data Protection Act n°78-17 of 6 January 1978, the Buyer has the right to access, rectify, oppose and delete data concerning him/her by contacting « Pride Racing Parts ».
